This Privacy Policy is in effect for the Site, any web page, third party social media site, e-mail list, onsite data collection, generic information and Personal Information (as defined below) collected and/or owned by us, including collection through the Site and any online features or services we offer (collectively with the Site, the “Web Properties”).

This Privacy Policy describes how we collect and use your information and under what circumstances we will disclose any such information. We suggest that you review this Privacy Policy periodically as we may update it from time to time.

What Information Do We Collect?

Spartan Energy Acquisition and any third party we engage for the purpose of administering, operating, hosting, configuring, designing, maintaining and providing internal support for our Web Properties, may collect usage information, personal information, and other information you provide when you visit the Web Properties.

We collect this information to help diagnose problems, administer our Web Properties and track usage statistics. All of this information is collected and used only in the aggregate; that is, it is entered into our database where we can use it to generate overall reports on our visitors, but not individual reports that identify you personally.

Whether you submit any Personal Information to us is entirely up to you.  You are under no obligation to provide Personal Information.  However, this information is essential for the provision and quality of some of the services we offer to you, so we cannot provide you with certain services or respond to  your inquiries if you choose to withhold requested information.

How Do We Use Cookies and Other Tracking Mechanisms?

“Do Not Track” Signals: Note that your browser settings may allow you to automatically transmit a “Do Not Track” signal to websites and online services you visit.  Like many websites and online services, we currently do not alter our practices when we receives a “Do Not Track” signal from a visitor’s browser. 

 

How Do We Use Your Information?

We use the information we collect to respond to your inquiries, improve our communications, improve our Web Properties, analyze usage, troubleshoot problems, and resolve disputes.

We use the information we collect to generally improve the content and layout of the Web Properties, to notify you about updates to the Web Properties, and for our internal review. When you supply us with Personal Information, the information you provide will be added to our database. You may receive periodic communications from us. When May We Share Your Information with Third Parties?

The limited instances where we may share your Personal Information include:

  • We contract with third-party service providers in order to operate our business. Those service providers may need access to your information to perform fulfillment and other services. We may do so when: (1) permitted or required by law (for example, to respond to a lawful subpoena, warrant or court order); (2) trying to protect against or prevent actual or potential fraud or unauthorized transactions; (3) investigating fraud which has already taken place; or (4) we believe that disclosure is necessary to protect our rights or interests, or the rights or interests of others.
  • We reserve the right to transfer the information described in this Privacy Policy in connection with the a merger, sale or other disposition of all or part of our business and/or assets. We cannot make any representations regarding the use or transfer of your Personal Information or other information that we may have in the event of our bankruptcy, reorganization, insolvency, receivership, or an assignment for the benefit of creditors, and you expressly agree and consent to the use and/or transfer of your Personal Information or other information in connection with a sale or transfer of some or all of our assets in any of the above described proceedings.  Furthermore, we cannot and will not be responsible for any breach of security by any third parties or for any actions of any third parties that receive any of the information that is disclosed to us. 

We do not provide contact information to third party marketers without your permission. We share your information with third parties only in limited circumstances where we believe such sharing is (1) reasonably necessary to offer our services, (2) legally required or, (3) permitted by you.

 

How Do You Know Your Information is Secure?

We have appropriate security measures in place in our facilities to protect against the loss, misuse or alteration of information that we have collected from you so you can feel comfortable and secure. Although these precautions should help to protect any personal information available through the Web Properties from abuse or outside interference, a certain degree of privacy risk is faced any time information is shared over the Internet. We cannot guarantee the protection of information against interception, misappropriation, misuse, or alteration or that your information may not be disclosed or accessed by accidental circumstances or by the unauthorized acts of others.

 

Children Under the Age of 18

We will not knowingly collect personally identifiable information from any person under the age of 18. Our services are not designed to attract the attention of persons under the age of 18. You affirm that you are more than 18 years of age, or an emancipated minor, or possess parental or legal guardian consent, and are fully able and competent to enter into the terms, conditions, obligations, affirmations, representations, and warranties set forth in this Privacy Policy, and to abide by and comply with this Privacy Policy.  In any case, you affirm that you are over the age of 13, as THE WEB PROPERTIES ARE NOT INTENDED FOR CHILDREN UNDER 13 WHO ARE UNACCOMPANIED BY THEIR PARENT(S) OR LEGAL GUARDIAN(S).

 

Third Party Sites

The Web Properties may now or in the future include links to websites not operated by Spartan Energy Acquisition LLC (“Third Party Sites”). Spartan Energy Acquisition LLC is not responsible for and does not control the views expressed by, the content provided by, or the privacy practices exercised by any Third Party Site. We are also not responsible for the privacy practices of any Third Party Site. We encourage you review the individual privacy policies of any Third Party Site to learn more about how they collect and use personally identifiable information before submitting any personal information. Such Third Party Sites do not have access to any personal information or data you provide to us within the Web Properties. This Privacy Policy applies solely to information collected by us or by one of our service providers on our behalf.

 

European Union Users

If you are visiting us from the European Union, please note that we may collect, transfer, and continue to use your Personal Information outside the European Union for any of the purposes described in this Privacy Policy.  By using the Web Properties and providing us with your Personal Information, you consent to our collection, transfer, and continued use of your Personal Information in accordance with this Privacy Policy.

 

Your California Privacy Rights

Under California’s “Shine the Light” law, California residents who provide certain personally identifiable information in connection with obtaining products or services for personal, family, or household use are entitled to request and obtain from us (once a calendar year) information about the customer information we shared (if any) with other businesses for their own direct marketing uses.  If applicable, this information would include the categories of customer information and the names and addresses of those businesses with which we shared customer information for the immediately prior calendar year (e.g., requests made in 2017 will receive information regarding 2016 sharing activities, if any). To obtain this information, please send an e-mail message to land@spartanenergyacquisitions.com with “Request for California Privacy Information” in the subject line and in the body of your message.  We will provide the requested information to you at your e-mail address in response.  Please be aware that not all information sharing is covered by the “Shine the Light” requirements, and only information on covered sharing will be included in our response.

 

Governing Law

This privacy policy is governed by the laws of the State of Colorado, without regard to its choice of law rule and without regard to the location of any user. By using or accessing the Web Properties, you agree that any action at law or in equity arising out of or relating to your use of the Web Properties or this Privacy Policy will be filed only in the state or federal courts in the State of Colorado, and you hereby consent and submit to the personal jurisdiction of such courts for the purpose of litigating any such action.

 

Changes To This Privacy Policy

From time to time, we may use the information you provide us for new, unanticipated uses not previously addressed in our Privacy Policy. If our information practices change at some time in the future we will post the policy changes on the privacy page of the Web Properties to notify you of these changes. We encourage you to check the Web Properties periodically for more information on what information we collect, how we use that information and under what circumstances we may disclose that information to others.  Your use of the Web Properties following such publication of any amendment of this Privacy Policy will signify your assent to and acceptance of its revised terms for all previously collected information and information collected from you in the future.  We will indicate near the bottom of this page the date this Privacy Policy was last revised.
